It would technically apply the same, but if you notice the staff conveniently ignores threads which happens to contain uploads of material that is on that list. It's more of a scapegoat. It's unrealistic to think that people aren't going to upload licensed material especially considering how difficult it can be to keep track of what is licensed, what may be licensed, and what will likely never be licensed.
You can either just not allow uploads or turn a blind-eye to such uploads until C&D letters show up and you terminate the topics that link back to those downloads and actually ban future topics.
Its easy enough to do that because Fakku doesn't host those links themselves. An anime company can request (or legally force their hand) so that Fakku has to delete all of the links, but there isn't anything that Fakku could be held responsible for, not in User Uploads anyway.
I mean if you want to get technical even non-US licensed anime is still illegal. However, in order to prosecute, Japan would have to go through the U.S. court system (or any other country in question), and that just simply isn't worth their time. Fansubbers aren't invincible, but the Japanese government doesn't take the effort to go after them, only the United States will once the anime is licensed.
