The issue with that is a company needs something to stand on to promote itself. To create a brand new site and possibly even a name is not feasible for a business. Fakku already has a name and something substantial to make the promotion of hentai possible since they are very well known. Anything made outside of the name as a child to this site would only be a shadow of it's predecessor so the probability of that company succeeding is much lower. In all honesty this had the potential to fail as well, it is not easy to break into an industry in this day and age regardless of what it is, but fakku has been doing very well if not better then expected.
Also companies would not support the combination of both pirated and legalized material. Even if both were separated and under different names, anything that could or can be connected would reflect poorly on the company trying to start up. Even the combination of both pirated and legal on here as of now is not common typically, but it takes time to change and that is what has been happening over the past year or so. You just arrived late to the party so it's all hitting you now which is understandable, no one was 100% happy, myself included had to get use to things.
I think the community should take pride in the fact that fakku has come as far as it has. I know not everyone can share in the glory of owning hentai and other such related material, but no one has forgotten where they have come from and what it took them to get here. There was one post I read where Jake gave gifted graciously people that helped him out years ago when fakku had it's first serious financial troubles. They're really been working hard on doing what they've always intended to do. It was never about free, it was about having people enjoy something they couldn't enjoy otherwise. Yeah the process has been a bit rocky, but as I said this is all new. It's not like there is a guidebook that tells you how to go about things, but honestly it's been handled as best as possible.
