I think Japanese anime companies need to rethink their distribution strategies. Their products are getting pirated on a ridiculous scale through fansubs, and they're not seeing a penny. What they ought to do is beat them to it, and release their own subs on a website they can collect advertising revenue from.
The copyright act is more or less fair, unfortunately for pirates. People ought to get paid for their work. What they fail to realize is that they're blaming all their business problems on piracy, and I sincerely doubt all their profits will magically double once all the pirates are hung from the gallows. Take a look at the anime series you've downloaded and watched for free over the years, if these HADN'T been fansubbed, how many do you think you would of heard of, then bought and watched?
Some companies are already doing that. Look at Naruto. Viz has the latest episodes available for free on CrunchyRoll, subbed. But people are still spreading the fansubs, because the video quality of the episodes on CrunchyRoll are horrible, especially for people used to the excellent quality of fansubs.
The real problem, however, is that the Japanese companies who make the shows won't benefit from that sort of thing. Only the American companies who buy the rights to distribute the series in America benefit.
So, if a series comes out in Japan and never gets licensed in America (and that happens to a lot of series, even popular ones), it doesn't matter if American fans watch fansubs of the series, because they don't have the option of paying for it. Sure, they could buy the Japanese DVDs, but that'd be worthless if the person didn't know Japanese.
