Even the last part of the description of "Unavailable Publishers" specifically says "or we're still negotiating" and, of course, no matter how unlikely it may be right now, things can change at any time.

"Blacklisted" is absolutely an inappropriate term. I don't see a reason to use it other than an attempt to stir up drama (case in point), so please don't.
