I wasn't sure where to put this topic so I decided with the random section. But a few days ago, I ordered some hentai manga from hmv.jp and I realized that one of them had a cover with a girl of questionable age. So I started too worry so I went to cancel my order but it was too late because they were already in some sort of transit and couldn't change or cancel my order. They haven't charged my card yet so I plan to dispute the payment in order to stop it. But incase the payment does go through and I am not able to dispute it and they have already shipped it, what am I going to do? How likely is customs going to check a package of 3 books and what do I do if they find out? The package is sent by EMS and from my searches online it seems that they check large enough packages and ems. I live in the US and made an account here just to see what you guys think. The book I am concerned with is Hisasi's Shoujo no Toge. Any suggestions?
The US doesn't have any legal sanctions on the content of art under the first amendment. Doujins fall under the category of art. There should be no legal repercussions whatsoever. What state tho? that may make a difference
I live in California but I have heard of people still getting in trouble for the possession of stuff like this in the U.S thought so I am not sure.
The only guy ever got caught without actual CP plead guilty to obscenity thru the mail. That case also killed the drawing parts of the protect act which is the federal CP law. Problem is anyone can be charged for anything, it's just the court dismisses the unlawful ones, but with cp and obscenity there certain steps. As long as the media isn't of a real person nor realistic then CP is out but under California v. Miller there certain criteria of what lawful vs obscene.
The Miller test was developed in the 1973 case Miller v. California.[2] It has three parts:
Whether "the average person, applying contemporary community standards", would find that the work, taken as a whole, appeals to the prurient interest,
Whether the work depicts or describes, in a patently offensive way, sexual conduct or excretory functions[3] specifically defined by applicable state law,
Whether the work, taken as a whole, lacks serious literary, artistic, political, or scientific value.[4]
The work is considered obscene only if all three conditions are satisfied.
This also was used for a real series of porns which the person was an adult and they ruled they were obscene because she look underage, but in the world of hentai... nothing but milfs, stated adults or business/sensei characters could be under age... like the highschool girl or boy manga. Any good lawyer who know anything can state this in pre-trial. There only a few lolicon book which this could be obscene. Problem is your faith is on 12 people who are normies and not like us. Judges are smarter than people with no jobs or life. Your case the book is clearly not obscene.
