Everyone seems to be over-reacting to this, in my opinion.
Let me say something, There is NOTHING new under the sun. NOTHING. At ALL. You think something you made is unique? Nope, someone already thought of it, I promise you that.
There are some people who copy directly, and while some of those screens are, some of those screens mean absolutely nothing.
You are saying I can't have a character plunge his fist into someone's chest without it being plagiarizing Grimmjow's attack on Rukia?
I can't have a blood crazed Maniac with Scars on his face without him being a copy of Zaraki, nor can I have any character slam a creature down bodily with one hand into the ground without being a plagiarizer?
If I have a character that flies and has horns, that automatically makes him a copy of one of Ulquiorra's forms, no matter how different they are otherwise?
I can't have a closeup of someone as they pull back a fist before they punch someone, because that is a copy of Chad when he did the same thing?
NOTE: I AM NOT SAYING THE GUY DID NOT PLAGIARIZE, SOME OF THOSE SCENES ARE BLATANT RIPS, I AM SAYING THAT YOU CAN'T CALL SOMETHING A RIP-OFF JUST BECAUSE THERE ARE SIMILAR SCENES TO IT IN SOME OTHER MANGA ELSEWHERE!
In this instance, I believe it is a blatant copy of some well known manga.
While i don't view being inspired by someones work, or doing a study of their work as plagirism, not admitting to the source is, and its made worse by doing it for profit.
I'm all for great stories that inspire a dojinshi, parallel timelines, derivative works, but i just don't think that this is the case.
Think of how many well written stories are based of Bram Stroker's Dracula:
Games:
Darkstalkers
Vampire:the Masqurade
Castlevania
Comics:
Buffy the Vampire Slayer
Books:
Twilight Series
Movies:
Blade(trinity, to be exact since it references dracula)
Nosferatu
Dracula (the 1930's one)
Dracula (the 1990's one which is based on the book)
You can make a story, art and music based on an idea, but most of it is very original.
My issue is that the overlays aren't only similar(it's statiscally possible), they are close to exact (very close to impossible).
Masashi Kishimoto, was influence by Akira Toriyama in his work on Naruto,(hell the characters have the exact color scheme when compared to goku in ss1), so you can admit to the influence but to call Db and Naruto a plagerized work is not on par as to what we have with the Nick Simmons situation.
Anyway, the true test will be a copyright law suit. If Radical settles out of court, it was plagerism. If the court finds Radical Guilty of plagerism, its plagerism. If the courts absolve Radical of plagerism, then its not. Until then we can argue it until the cows come home.
I couldn't do what Nick Simmons did because my personal code of ethics wont allow it. And that's how I measure my decision in this matter.
