This is a prime example of Shrodingers cat.
A cat is sealed in a box with a vale of poison set to designate at a random unknown time. Until the box is opened, the cat can be both considered as a alive and dead.
In other words, you can only define a lie once the box is open. Meaning, once you have given incorrect information.
As silences is considered as not giving information you could say, "No, Silence is not lying"
However, you could also say that in situations, by not giving information it would suggest the opposite of the question and could be considered as a lie.
But persoanlly, I do not see silence as lying. I see it as silence.
This is nice that someone is using actual terms.
Again, this situation can be answered on how you perceive it.
If you believe failure or omitting to give out information is lying that is fine.
If you believe saying nothing is not lying that is also fine.
