Looks like your neighborhood hub is either outdated, damaged, or overloaded. They should really fix that. The last time my internet began to behave erratically, it turned out there was water in the cable. That wasn't the only problem, though - it turned out that the modem was not functioning correctly, either. It took a couple of weeks replacing lots of cables and devices to fix the problem.
...Speaking of which, I've been getting random outages recently. I should look into that.
Actual technical issues aside, you'll find that most ISP's will deliver you UP TO the advertised service speed, but hardly ever exact and never more. I also seem to recall a clause in my ISP's contract that exonerates them from this speed discrepancy. Oh, well.
Also, if you were referring to the Comcast vs. FCC case, the throttling refers specifically to
torrent traffic. As a matter of fact, Comcast's reason for throttling torrent traffic is the retain more bandwidth
for streaming video. Most other ISP's adopt a similar stance, so I'd doubt that is the reason for your problems.
