Motorola and Microsoft are arguing like kids, and most likely nothing will come of it. At the moment no verdict has been reached since while Motorola does in fact have the patent rights they're claiming, mainly the H.264 video-codec, this mess they have created trying to simply blackmail Microsoft into accepting their offer on about $4 billion is in violation of the FRAND agreement. So it will probably play itself out. Motorola will most likely be forced to let Microsoft use the video-codec for a cheaper price. However, there will most likely be a raise in prices for Microsoft products. Again.
Funny thing is microsoft does have a patent on avc h.264 for creation and uses in 16 counties( i actually had to find the patent list.). They with other people created the codec in the ITU-T Video Coding Experts Group which had Microsoft, Motorola and five other companies there working on this codec and brain storming a better one also.
Which is funny because even if they would make them pay the 4billion.. the 360 is going to be a dead console soon anyways. Only people buying ps3 and xbox now are replacing there dead machines. Maybe a few kids with mommy debit card or something.
Motorola doesn't even do anything anymore. Meh 720 in one year.
