Since he has already admitted to his crime (and what's worse, coram publico), he's ready to be crucified in a court of law.
Even if he doesn't get jail time, as long as he's convicted, he's gonna be registered as a sex offender and can pretty much go kiss a train.

She isn't even the plaintiff in the case. The public prosecutor is suing the defendant, because the defendant's being charged by the state with indecency. Why you would (or would even be able to) "counter-sue" her is beyond me.
