Who's at Fault?

You guy's have probably heard of the woman who fell off the Carnival Cruise ship.

She fell a total of 7 stories, and tread water for approximately 90 minutes while bleeding in shark infested waters. She was Soaked, freezing, and in pitch darkness the whole time. It takes a tremendous amount of willpower not to give up in such conditions. I commend her courage and glad she's safe.

The woman and her attorney are now suing the cruise line, alleging that Carnival "abandoned [her] in the middle of the ocean for an unreasonable amount of time."

Why did they wait so long too turn back? Well according to the cruise, they took so long to go back and get her because most people who disappear on a cruise are still somewhere on the ship. They wanted to check the ship first before changing course.

Then it comes out that the reason for her going over board was due to her being drunk. But she claims her getting drunk was the cruise's fault saying the bartenders encouraged her to buy more drinks by offering her these coupons to the ship's casino.

This is where my question comes in. Ultimately who does the fault belong too? Is it the Cruise's fault for trying to get there customers to spend money and then taking too long too rescue her? Or is it the woman's fault for not having the ability to so "No." If she told the bartenders "no, one drink's good for me", this event would never have happened. Or is it both their faults.

What do you say?

It's her fault. She was a moron who could not hold her liquor. People need to learn to take responsibility for their actions. If anything, she should be grateful that she is not in a piece of shark turd right now.

I agree with you 110%. Knowing your alcohol limit is drinking 101. Not knowing it can put you and/ or others in danger. She learned that the hard way. If she was smart, she'd lay off the booze for awhile.

It's most definitely her own fault. Any bar whether it be on a cruise or in a town, will always offer you more booze and always try to get you to buy more. It's her decision to continue drinking or not. She couldn't hold her booze :/ hey at least they went back and saved her sorry ass.

People like this make me want to punch babies. Although I would never punch a baby.

Well it's not like they could just leave her out there. What urks me is that after saving her, she's has the balls to sue for them not saving her fast enough.



I understand your rage but wouldn't punching a baby be counter productive? Why not just punch her? Someone has to knock some sense into her, might as well be you.

It is slightly both. She was acting irresponsible and drank too much which caused her to fall overboard. However, when someone comes onto a cruise ship, it is the crew's responsibility to make sure the passengers are taken care of and should have done better job to search for her in the water. Situations like this can't really be blamed on one person.

One argument can be that the fault can be put partially on the passengers. a women falls overboard screaming and no one hears it? an argument can be said the passengers just don't pay attention and could have helped out. Like her friends for instance If they had been paying attention to a DRUNK friend in the room, and saw her leave to the balcony and not return, it would have been simple to say that "hey, I think she fell overboard."

These situations are terrible and thank god she's ok, but sometimes stuff happens and not one person can be blamed for it.

Just because they give you a free drink ticket doesn't mean you have to use it. If she was ugly I would have never turned around the boat, I would have just kept going...dumb bitch.

I understand where your coming from, and if they had done things differently it could have changed the outcome. But sadly the cruise is a business, and they have a set of rules to abide by. The bartenders were just doing there job when they were telling her to have another drink. She could've said "no", but she didn't.
If the ship's employee's paid more attention to her, they could've prevented her fall. But they were dealing with the other couple of hundred people on that same ship. Unfortunately they can't pay attention to everyone. It just isn't possible.
The Captain could have turned the ship around sooner to save her, but he has to follow procedure. So he checked the ship top to bottom to make a 100% sure she wasn't on board before he turns the ship around. He has to do this in case some one sues him or the company.



I'm sorry but I can't agree with this. Unless someone personally saw it happen, they can't be responsible nor should they be. And with the noise inside the ship plus the wind and waves outside, how could anyone hear her fall?



If any passenger could have helped, it would have been her friend. But from what I've read she was in the bathroom when it happened. And when she did find out she went to the captain to plead to turn the ship around. So it seems like she did all that she could have done.

I know right, that's what puzzled me, was they saved her, and she tries to sue because it took them too long :/ wtf. Darwin award goes to.

I've been drunk several times and every time i still have enough mind to not fall off of a balcony. Also just because you are offered something doesn't mean you have to accept it

Just from the picture, she looks overweight and lazy. I have trouble believing that someone like that survives for 90 minutes in ice cold water, hysterically thrashing & bleeding out. I also have issues believing that a cruise ship company just passes by 16 hours before giving her proper medical care, all the while her friends give the staff of the ship terror. I can't stress enough how you would look and in what state your body would be in after 90 minutes in ice cold water. The story must also have been a while ago or she really has incredible willpower that, after all the life threatening shit she went through (That would be traumatizing enough to put most people of this age into permanent mental therapy.) she still has her thoughts on how she's looking on camera and puts on several layers of makeup. It's obviously her fault either way, but the whole story seems to be pulled out of several different asses.

As for the topic itself, I honestly believe it is the lady's fault. She should have been responsible enough to know when enough's enough, but it doesn't look like she is. The cruise-line does have the right to try to sell more drinks, and that's fine because it comes down to the customer's choice. However, I bet the cruise-line could have rescued her quicker than they did.

What I don't get is why people are saying the ship could have saved her faster? Considering the situation, 90 minutes is actually a pretty quick response. You all have to understand, a cruise ship is large, and the interior's are a maze. Who knows where a drunk person could stumble off to. And considering that the friend didn't see her fall off a balcony, but assuming she did, and while intoxicated, the crew would have a viable reason to question the validity of her accusation.

As for the medical personnel, it depends on what they had in their inventory. From what I read, her life was not in any immediate danger after they pulled her out of the water, the medical staff being able to put her under a stable condition. Air lifting a person is for those who are under extreme conditions, heavily wounded, and the medical staff do not have the material to aid the person. Like I said, the woman was in a stable condition, though in a lot of pain, but could survive until they reached port. As for their lack of treatment, well, they are merely medical staff on a pleasure cruise, they aren't outfitted to treat and heal people of serious injuries and conditions. They had enough to keep her stable, numb the pain, and pills to lessen the clots. They aren't a floating hospital.

And the funny thing, no one questioned how she fell off the balcony. If you've seen those things, the railing is averaged around four feet in height. Those things are made so a person can't just "fall off." From my understanding, there was a couple that tried to sue when their kid fell off a balcony. The child was 2 and the railing was larger than himself, the cruise liner is not responsible when a person exceeds effort to hurt themselves.

Now that you mention it, she never did mention why she was outside or how she fell off. That is an interesting point.

This happens quite a bit from what i understand, usually the drunk person falling over balcony scenario is usually the drunk persons fault. Like others have said, they should learn there own limits. The only question i have is dose the cruise not have any speed boats aboard the ship that it could fire in these situations? It seems like something that wouldn't be too out of line.

So many choices. Her's for being drunk. The captain's for not turning around immediately. The bartender's for giving her coupons. Her friends' for not just getting in a lifeboat and going down after her. We should also consider who gave her the idea to go on a cruise for her birthday in the first place. This wouldn't have happened if she wasn't there to begin with. We might as well throw in whoever invented luxury cruise ships in the first place as well. To answer your question, I can't say. Everyone contributed.
